After the continuous hearing of Six days number of Pensioners are now asking when this Judgement will be pronounced by the three judges Bench Even the Senior Advocate can not say any specific date of pronouncing the Judgement. Only some assessments can be made.

Firstly Hon’ble Justice UU Lalit is going to resume the charge of Chief Justice of India on 27 th August 2022, so he may deliver the Judgement before 27 th August 2022 as he said that they have to deliver the judgement when he declined to accept the counter affidavit of pensioners lawyers. The three Judges’ Bench is still having two weeks’ time to deliver the Judgement.

Secondly, this Judgement is not an ordinary judgement as it involves around 67 Respondents.

A large no.of Affidavits and counter-affidavits involving countless documents are part of this case. This reserved Judgement will be a historical judgment impacting around 65 lakh pensioners. Now comes the question of how much maximum time it may take. Hon’ble Justice UU Lalit is going to retire on November 8 so the maximum time for delivering judgement can not exceed 88 days from today. This does not mean the pronouncement of Judgement will certainly take this much time of 88 days.

It is relevant to mention here that when the Hon’ble Kerala High Court delivered its judgement it took nearly Six months after the completion of the hearing to pronounce the Judgement. One more point the undersigned wishes to make, pensioners must be prepared to expect any type of Judgement.

After watching the proceedings of the Hon’ble Supreme Court closely for Six days undersigned wishes to express the fair assessment that both the parties fought this legal battle very effectively but taking into legal aspect of the case Pensioners’ lawyers took the edge to their side but it also seems that the weapon of financial sustainability in the arsenal of EPFO was also used forcefully by EPFO/GOI lawyers by mentioning that making amendments in the act is well within their legitimate jurisdiction but the exaggerated actuarial estimation of 15 lakh Crore has not been completely well taken by Hon’ble Bench.
